1. Acceptance of these Terms

These Terms of Use ("Terms") govern your access to and use of the FitClutch mobile application and website (together, the "Service"), operated by Wave Negócios Digitais ("FitClutch", "we", "us"), based in Joinville, Santa Catarina, Brazil. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

FitClutch generates a workout plan based on the information you provide (goals, experience level, available equipment, training days, and similar answers). Your Fitness Score and suggested load progression are calculated from your own data and training history — they are not generic or decorative figures. FitClutch does not replace the judgment of a certified trainer or medical professional.

3. Eligibility

You must be at least 16 years old to create an account. If you are under the age of majority in your country, you confirm you have permission from a parent or legal guardian to use the Service.

4. Account Registration

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.

5. Subscriptions, Billing & Cancellation

FitClutch offers free and paid subscription tiers. Paid subscriptions are billed and managed through the Apple App Store or Google Play, depending on your device, and automatically renew unless canceled before the renewal date. The total price and cancellation terms are always displayed in the same font size as the rest of the screen — never hidden in fine print.

• Cancel anytime directly through your App Store or Google Play account settings. Deleting the FitClutch app or your in-app account does not cancel an active subscription — you must cancel it separately through the store where you subscribed.
• Refunds are handled according to Apple's and Google's own refund policies, since all payments are processed by those platforms.
• If a free trial is offered, its exact duration is shown before you confirm any subscription.
• Brazil — right of withdrawal: if you are a consumer in Brazil, you have 7 (seven) calendar days from the date of purchase to withdraw from the subscription and request a full refund, with no justification needed, under Article 49 of the Brazilian Consumer Protection Code (CDC). After this period, you may still cancel future renewals at any time, but the current billing period is non-refundable.
• EU / UK — right of withdrawal: if you are a consumer in the European Economic Area or the United Kingdom, you may have the right to withdraw within 14 days of purchase under EU/UK consumer law. By choosing immediate access to the Service, you acknowledge that this right may be waived once the digital content or service has begun, to the extent permitted by applicable law.
• To request a refund under either right above, use the refund request tool provided by the App Store or Google Play, or contact us at contact@appfitclutch.com and we will guide you to the right channel.

6. Health & Fitness Disclaimer

FitClutch provides general fitness guidance based on the information you enter. It is not medical advice and is not a substitute for consultation with a physician. Consult a doctor before beginning any exercise program, particularly if you have a pre-existing health condition, injury, or are pregnant. You use the Service and perform any exercise at your own risk.

7. Acceptable Use

You agree not to: misuse the Service to harm others; attempt to reverse-engineer, scrape, or resell the Service; upload unlawful, abusive, or infringing content; or interfere with the Service's normal operation.

8. Intellectual Property

The FitClutch app, website, branding, workout logic, and content are owned by Wave Negócios Digitais or its licensors. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, FitClutch and Wave Negócios Digitais are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including any injury resulting from exercise performed based on app recommendations.

11. Governing Law

These Terms are governed by the laws of Brazil. Any dispute will be subject to the courts of Joinville, Santa Catarina, Brazil, unless local consumer-protection law in your country requires otherwise.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated in the app or by email before they take effect.
